Thanks for using our products and services (“services”). The services are provided by OneInMath.com (“OneInMath”), located at 4021 Emerald Isle Lane, San Jose, CA 95135, USA.
By using our services, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern OneInMath’s relationship with you in relation to our Services. If you disagree with any part of these terms and conditions, please do not use our services.
The term ‘OneInMath’ or ‘us’ or ‘we’ refers to OneInMath.com, its officers, directors, employees, agents and assigns. The term ‘you’ refers to the user or viewer of our services, as well as all students that are registered by you to receive services from OneInMath.
USING OUR SERVICES
You must follow any policies made available to you within the services.
Don’t misuse our services. For example, don’t interfere with our services or try to access them using a method other than the interface and the instructions that we provide. You may use our services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Using our services does not give you ownership of any intellectual property rights in our services or the content you access. You may not use content from our services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our services. Don’t remove, obscure, or alter any legal notices displayed in or along with our services.
Our services may display some content that is not OneInMath’s. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.
In connection with your use of the services, we may send you service announcements, administrative messages, and other information. There is no provision to opt out of these communications.
In order to provide services to you and your students, OneInMath will share your personal information including but not limited to name, email, phone number and other information that is part of your and your student’s profiles, progress history and other communication, etc. we track as part of providing the services to you and your students, with other users (volunteers) who help us provide you these services. There is no provision to opt out of it.
We do not share your personal information with any third party for commercial reasons. We are a volunteer driven organization, run by volunteers who donate their time to OneInMath, and by monetary donations from the founders and well-wishers.
YOUR ONEINMATH ACCOUNT
You may need a OneInMath Account in order to use some of our services. We require you to login with a third party provider like Google. When you login through third party providers, we create an account for you. We retrieve and store information like your name, email address, photo, access token and other information granted by you, or publicly available information about you. We do not have access to, nor do we store, your password.
PRIVACY AND COPYRIGHT PROTECTION
OneInMath’s privacy policies explain how we treat your personal data and protect your privacy when you use our services. By using our services, you agree that OneInMath can use such data in accordance with our privacy policies.
PHOTO/VIDEO RELEASE
As part of registration and participation in classes conducted by OneInMath, you and your registered student(s) (“Releasee”) may be photographed and video taped. You grant permission to OneInMath (“OneInMath”), all entities, affiliated or associated with OneInMath and, at OneInMath’s sole discretion, entities that contract with OneInMath to do the following:
Record, edit, use, reproduce, publish and distribute by way of photograph, video, television and all other media (electronic or otherwise) the visual and/or audio likeness of Releasee. OneInMath is further granted permission to use such likeness for news, educational, marketing, advertising, fund-raising or other reasonable purposes.
By agreeing to this Photo/Video Release, it is agreed that OneInMath will be held harmless from any liability resulting from the statements and actions captured as set forth above, and OneInMath is hereby released from any claims relating to the rights granted above.
You understand that this Release is entered into on behalf of the Releasee and each of Releasee’s heirs, agents, successors and assigns. You further understand that Releasee will not receive any compensation for this release; however this Release is a condition of and a part of the consideration for your and your students’ participation in the OneInMath programs. You further understand that although this Release is granted, OneInMath is under no obligation whatsoever to use your or your students’ audio or visual likeness.
You represent that you are 13 years of age or older, or the parent or legal guardian for the Releasee, have read and understand the content of this release, and agree to the terms hereto.
YOUR CONTENT IN OUR SERVICES
Our services may allow you to submit content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.
When you upload or otherwise submit content to our services, you give OneInMath (and those we work with) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our services, and to develop new ones. This license continues even if you stop using our services. Make sure you have the necessary rights to grant us this license for any content that you submit to our services.
You can find more information about how OneInMath uses and stores content in the privacy policy. If you submit feedback or suggestions about our services, we may use your feedback or suggestions without obligation to you.
VOLUNTEERING
If you choose to volunteer for OneInMath, you agree to donate your services, without limitations or restriction, to OneInMath. No conditions are attached to the service which you are prepared to donate, and you understand explicitly that for such services OneInMath shall not, and is under no obligation to, provide you with pay, compensation, emoluments, or any other thing of value, and to this extent, you do hereby for yourself, your heirs, and assigns forever discharge and release OneInMath from the same and all claims or demands for the same.
You will be responsible for maintaining proper safeguards for OneInMath property and will not interfere with activities undertaken by OneInMath. You agree to abide by all applicable administrative regulations, directions, and instructions which are issued by OneInMath, particularly those concerning donation of services and the qualifications therefore. Equipment and facilities furnished to you by OneInMath shall be devoted to the pursuit of work having value to the work to OneInMath. You agree that the results of your service will be turned over to OneInMath, that OneInMath will have unlimited rights in all work that is derived and that all inventions made by you during the course of the donated service. “Unlimited rights” as used herein means the right to use, duplicate, and disclose in whole or in part, in any manner whatsoever, and have others do so. You understand that services, which you donate, may be rejected or discontinued at any time by OneInMath.
You will have access to personal information of your students, parents and other volunteers. You agree to use such information for the sole purpose of performing your volunteering duties for OneInMath. You agree to not share such personal information with anyone else who doesn’t already have access to this information. You also agree to not transfer, copy, or save such information in any other location or medium except what is provided to you within the OneInMath system.
MODIFYING AND TERMINATING OUR SERVICES
We are constantly changing and improving our services. We may add or remove functionalities or features, and we may suspend or stop a service altogether.
You can stop using our services at any time, although we’ll be sorry to see you go. OneInMath may also stop providing services to you, or add or create new limits to our services at any time.
OUR WARRANTIES AND DISCLAIMERS
We provide our services as is possible within our resources and limits. There are certain things that we don’t promise about our Services.
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER ONEINMATH NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTION OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, ACCURACY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.
SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.
LIABILITY FOR OUR SERVICES
WHEN PERMITTED BY LAW, ONEINMATH, AND ONEINMATH’S SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ONEINMATH, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIM UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).
IN ALL CASES, ONEINMATH, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
BUSINESS USES OF OUR SERVICES
If you are using our services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify OneInMath and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
ABOUT THESE TERMS
We may modify these terms or any additional terms that apply to a service to, for example, reflect changes to the law or changes to our services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a service, you should discontinue your use of that service.
If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
These terms control the relationship between OneInMath and you. They do not create any third party beneficiary rights.
If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
If it turns out that a particular term is not enforceable, this will not affect any other terms.
The laws of California, U.S.A., excluding California’s conflict of laws rules, will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts of Santa Clara County, California, USA, and you and OneInMath consent to personal jurisdiction in those courts.
